U.S. Senate Bill could ‘nudge’ the elderly to choose premature death

This bill would – no doubt in my mind – enable Compassion and Choices [C & C] to meet its ambition of becoming the Planned Parenthood of death by receiving government/insurance funding. From the bill:
C) The requirements established by the Secretary under subparagraph (A)(ii) shall include a requirement that interdisciplinary team members (except for the chosen chaplain, minister, or personal religious or spiritual advisor) have training and experience in delivering person-directed planning services and in team-based delivery of services for individuals with dementing illness and individuals with a serious or life threatening illness.

C & C primarily pushes assisted suicide, but also pretends to be about such counseling. It has worked with federal legislators before on worming itself into federal funding. If passed, I believe his bill would give the organization access to Medicare funds.

Last week, U.S. Senators Mark R. Warner (D-Va.) and Johnny Isakson (R-Ga.) introduced S. 1549, the Care Planning Act of 2015, to use federal tax dollars to pay health care professionals to counsel older people in deciding whether to accept or reject life-preserving medical treatment, food and fluids.

On its face, S. 1549 purports to promote neutral, fully informed “advance care planning” that will assist patients to implement their own values in legally valid directives. Unfortunately, however, there is abundant evidence, documented in the March 2015 NRLC report “The Bias Against Life-Preserving Treatment in Advance Care Planning,” that a combination of cost pressures and the ideological commitment of a significant number of health care providers to hastening death for those deemed to have a “poor quality of life” would in practice lead to many federally funded advance care planning sessions being used to exercise subtle – or not-so-subtle – pressure to agree to reject life-preserving treatment.

Entities conducting such programs openly boast of how much money they have saved insurance companies by inducing patients to reject expensive life-saving medical treatment. Advocates believe it will save Medicare money as well.

The pervasive focus of the Institute of Medicine September 2014 report “Dying in America” is summed up in its statement, “Because most people who participate in effective advance care planning choose maximizing independence and quality of life over living longer, advance care planning can potentially save health care costs . . . .”  (What this statement effectively means is that the Institute of Medicine report authors expect that “most people” receiving advance care planning counseling will come to agree they would rather die than live with dependence or a poor quality of life, and therefore will agree to forego expensive treatment that could preserve their lives when they are “not worth living.”)

BAKERSFIELD, CA.  December 26, 2014 – “Compassion & Choices has launched a dynamic campaign in California to make aid in dying an open, available, legitimate practice in the Golden State.  A number of legislators have expressed support for such a bill, and we are currently crafting the language for legislation that will be introduced in January.

“In July, 64 percent of Californians said they supported aid in dying, according to a poll by Goodwin Simon Strategic Research. But that poll was conducted before Brittany’s story galvanized nationwide support for death with dignity, so it likely underestimates demand for this choice in the state.  In fact, a recent online HealthDay/Harris Poll survey shows an overwhelming 74 percent of American adults now believe that terminally ill patients who are in great pain should have the right to end their lives. Only 14 percent were opposed.  [ The poll did not mention “suicide.”-editor]

“Across California, our organizers are on the ground talking to hundreds of people each week, building our supporter list and recruiting and training volunteers to do the same. We are meeting with local, county and statewide elected officials and community leaders for endorsements. We are working to pass resolutions supporting end-of-life options and to deprioritize prosecutions of physicians who practice aid in dying in cities and counties across the state. We are building alliances with other organizations and partnerships with key state leaders. We invite you to join us in asking candidates and elected representatives to support aid in dying in the Golden State.

“Death should be a time of peace, not a time of stress because no one bothered to have a conversation about their own or their loved ones’ end-of-life wishes. Let’s make the most of our family gatherings. Let’s start end-of-life conversations with our parents and our abuelitos [grandparents] to learn about the kind of medical care they would or would not want at the end of their lives.

We attended the Webinar this month by that title, hosted by the Institute of Medicine (IOM).  Their study of dying Americans, “DYING in AMERICA,” is not about excellence in medicine.  Rather, it’s an ongoing process to fundamentally change health treatment policies, especially for seniors.

AAHPM recognizes that in some faith traditions ANH is considered basic sustenance, and for some patients and families, ANH is of symbolic importance, apart from any measurable benefits for the patient’s physical well-being. Such views should be explored, understood, and respected, in keeping with patient and family values, beliefs, and culture. Good communication is necessary to allow caregivers to learn about patient and family fears about “starvation” and other frequently expressed concerns. At the same time, communication is essential to explain the patient’s clinical condition and that the inability to eat and drink can be a natural part of dying that is generally not associated with suffering. Judicious hand feeding and, in some situations, particularly if there is uncertainty about whether a patient will benefit from ANH, a time-limited trial of ANH may be useful. When a time-limited trial of ANH is pursued, clear, measurable end points should be determined at the beginning of the trial. The caregiving team should explain that, as with other medical therapies, ANH can be withdrawn if it is not achieving its desired purpose.  End excerpt…click link above for full statement.

HOWEVER…At this writing, the American leaders in the Catholic Church are not fully informed of the dangers of POLST, organ donations, and Living Wills.  There is no uniform direction from the Church.  In fact, a Catholic priest, Fr. John Tuohey, is behind the creation of POLST.  Fr. Tuohey is director of Ethics at Providence Hospital in Portland OR.  So, here’s a Catholic priest who endorses this dangerous document.

Blumenauer Leads Letter Urging Inclusion of End-of-Life Care Planning in Medicare and Medicaid.

Washington, DC – Today, Representative Earl Blumenauer (OR-03), along with 33 other Members of the House of Representatives, sent a letter to Centers for Medicare & Medicaid Services (CMS) Administrator, Marilyn Tavenner, to adopt recommendations that would adequately reimburse Medicare providers for having voluntary discussions about end-of-life care and planning with patients.

Currently, the time doctors spend having discussions with their patients about end-of-life care and planning is not reimbursed under Medicaid and Medicare. Without this incentive, these conversations are not happening.

A recent study in the New England Journal of Medicine found that more than one in four elderly Americans lacked the capacity to make their own medical care decisions at the end of life. Under those circumstances, care decisions fall to family members and doctors who may not know the treatment preferences of their loved one. Elderly patients with advance directives, however, are more likely to receive the care they want. Evidence also demonstrates that advance care planning and end-of-life discussions reduce stress, anxiety, and depression in surviving loved ones.

“Patients who wish to make clear their goals, values, and wishes through discussions with their trusted providers should have the opportunity to do so,” said Blumenauer. “In order to have these conversations, providers must have the adequate time, space, and reimbursement to conduct the complex and time-consuming discussions necessary to learn about the goals and values held by their patients and plan appropriately for their care. “

“Every organization that has seriously considered this issue, from the American Medical Association to the Institutes of Medicine, knows we have to start respecting people’s choices about how they face the end of life,” continued Blumenauer. “Making this simple change will have a profound effect on the way patients and their families spend their final days, and everyone deserves that dignity.”

WI Catholic Bishops Condemn POLST Forms Citing It Overrides Advanced Directives

Due to the serious and real threats to the dignity of human life that POLST and all similar documents
present, we encourage all Catholics to avoid using all such documents, programs, and materials.  The
POLST form should not be regarded as the standard model for designating treatment preferences.

FOR IMMEDIATE RELEASE |  July 26, 2012  Madison, WI – Yesterday the Wisconsin Catholic Bishops released a pastoral statement (pdf) on Physician Orders for Life Sustaining Treatment (POLST).  Entitled “Upholding the Dignity of Human Life,” the statement warns against the use of POLST forms in medical decision making. A POLST form does not require a patient’s signature and, according to the bishops, “bears the real risk that an indication may be made on it to withhold a treatment that, in particular circumstances, might be an act of euthanasia.” 

Pro-Life Wisconsin State Director Peggy Hamill offered the following comments:

“Pro-Life Wisconsin thanks the Wisconsin Catholic Bishops for their critical statement warning against the use of Physician Orders for Life Sustaining Treatment (POLST).  It will be a tremendous help to Pro-Life Wisconsin in our ongoing efforts to expose and limit the use of POLST here in Wisconsin, beginning with Christian medical providers.

“Brightly colored POLST forms are being presented to patients in Wisconsin and across the country who are viewed by caregivers as not worthy of life-sustaining care.  In other words, care, even minimal care, is viewed as futile or too costly. When attached to a medical chart, POLST can act to limit the use of life-saving treatment, technology, and even antibiotics and ordinary care such as food and hydration. POLST forms are presented to vulnerable patients often at a time when the patient’s appointed advocate should be the one making medical decisions.  Once the form is filled out and signed by a doctor or physician’s assistant, its effect is immediate and can override a patient’s own advance directive and judgments of the patient’s medical team on the scene.

“For well over a year Pro-Life Wisconsin has worked with local lawyers, medical personnel, clergy and patient advocates to educate on and advocate against the increasing use of POLST and similar documents in our nursing homes and hospitals.  We concur with the bishops’ recommendation to use a durable power of attorney for healthcare and avoid the use of living wills. Pro-Life Wisconsin provides free of charge our own Protective Power of Attorney for Healthcare (PPAHC) document. ”
